Acceptable Use / Terms of Use Policy for RBR Internet 2/5/25

1. Purpose
RBR Communications (“RBR,” “we,” “us,” or “our”) provides internet service to residents of participating residential buildings in Minnesota. This Terms of Use / Acceptable Use Policy (“Policy”) explains the rules for using the internet service we provide (the “Service”).
This Policy applies to all residents, occupants, guests, and any other person using the Service through a residence where RBR provides internet access.
By using the Service, you agree to comply with this Policy.
2. Nature of Service
RBR provides internet service only to residents in buildings where the property owner or manager has arranged for service. The Service is residential only and is intended for normal personal, household, and lawful use within the unit where it is provided.
Service is provided on a month-to-month basis unless otherwise required by law or by a separate written agreement between RBR and the property owner or manager.
RBR is compensated through a bulk billing arrangement tied to residential units, and service is made available only to authorized occupants of those units.
3. Authorized Use
You may use the Service only for lawful purposes and in a manner consistent with this Policy. You are responsible for all use of the Service occurring from your unit, whether by you, members of your household, occupants, or guests.
You agree not to use, or allow others to use, the Service to: • violate any local, state, or federal law • infringe the intellectual property or other rights of any person or entity • transmit unlawful, threatening, abusive, harassing, defamatory, obscene, or fraudulent material • send spam, bulk unsolicited messages, or other unauthorized advertising • distribute malware, viruses, or other harmful software • attempt to gain unauthorized access to any system, network, account, or data • interfere with, disrupt, degrade, or damage the Service or any other network or system • engage in activities that compromise the security or integrity of the Service • operate the connection in a manner inconsistent with normal residential use
4. Prohibited Network Activities
Use of the Service for the following activities is prohibited: • port scanning, vulnerability scanning, or probing without authorization • denial-of-service attacks or other attempts to overload systems or networks • running servers or commercial services that unreasonably interfere with network performance or are inconsistent with residential use, if prohibited by RBR • resale, redistribution, or sharing of the Service outside the unit or building served • tampering with any RBR-owned equipment, wiring, radios, network devices, or infrastructure • bypassing or attempting to bypass bandwidth limits, access controls, suspensions, or security measures
5. Equipment and Access
Any equipment provided or installed by RBR remains the property of RBR unless expressly stated otherwise in writing. You may not move, alter, disconnect, damage, or allow unauthorized persons to access RBR equipment.
You are responsible for using your own devices in a secure manner, including maintaining current antivirus protection, software updates, and strong passwords where applicable.
6. Suspension or Termination of Service
RBR may suspend or terminate Service to an individual unit immediately, without prior notice, if we determine in our sole judgment that: • this Policy has been violated • use of the Service is unlawful • a user’s activity threatens the security, stability, or performance of the network • suspension is necessary to protect RBR, the property, other residents, or third parties • required by law, legal process, or at the request of law enforcement or the property owner where permitted
Because service is provided on a per-unit basis, suspension may be applied directly to the unit involved.
RBR may also suspend service temporarily for maintenance, repairs, upgrades, emergency conditions, or other operational reasons.
7. No Guarantee of Uninterrupted Service
The Service is provided on an “as available” basis. Speeds, availability, and performance may vary based on network conditions, building infrastructure, interference, equipment limitations, maintenance, or other factors.
RBR does not guarantee uninterrupted or error-free service.
8. Monitoring and Protection of the Network
RBR may monitor network usage and performance as necessary to operate, maintain, secure, and improve the Service, to enforce this Policy, and to comply with applicable law.
RBR is not obligated to monitor all user activity, but we reserve the right to investigate suspected violations.
9. Privacy and Disclosure
RBR respects customer privacy, but we may disclose information relating to use of the Service when we believe disclosure is appropriate to: • comply with applicable law, court order, subpoena, or legal process • protect the rights, property, or safety of RBR, residents, the property, or others • enforce this Policy • respond to claims that use of the Service violates the rights of third parties
10. Limitation of Liability
To the fullest extent allowed by law, RBR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to use of, inability to use, or interruption of the Service.
RBR is not responsible for loss of data, security breaches on user-owned devices, service interruptions caused by third parties, or damages resulting from unauthorized access to customer equipment or accounts.
11. Indemnification
You agree to be responsible for any misuse of the Service from your unit and agree to indemnify and hold harmless RBR, its owners, employees, agents, contractors, and affiliates from claims, damages, losses, or expenses arising out of your violation of this Policy or misuse of the Service, to the extent permitted by law.
12. Changes to This Policy
RBR may update or revise this Policy from time to time. Updated versions may be posted on our website or otherwise made available to residents. Continued use of the Service after changes become effective constitutes acceptance of the revised Policy.
